1. AGREEMENT TO TERMS & CONDITIONS

1.1 Acceptance of Terms and Conditions

1.1.1 Please read this agreement carefully. Your use of this website and membership of Linguafun™ is at all times subject to these Terms and Conditions and all applicable laws. By accessing our website you agree to our Terms and Conditions set out below.

1.1.2 If you do not agree to these Terms and Conditions, you must exit our website immediately.

1.2 Changes to Terms and Conditions

1.2.1 We reserve the right, from time to time, with or without notice to you, to change these Terms and Conditions at our sole discretion. The Terms and Conditions applicable to your access to and use of this website will be the version that is current and displayed on the website as at each date you access the website. Your use of the LINGUAFUN™ website after changes are made means that you agree to be bound by such changes.

2. ACCESS

2.1 When you join Linguafun you will be allocated your usernames and password. You should ensure that the details do not become available to people outside of your school, nor should they be published in your school's electronic (PDF) newsletter, or on your school's website, intranet, blog, forum or any other Internet medium. Failure to maintain the confidentiality of your login details is a breach of these Terms & Conditions and may result in the closure of your account and a fine of £200. Linguafun reserves the right to take any legal action necessary to recover losses incurred as a result of this breach of the Terms and Conditions.

3. MATERIAL ON THIS WEBSITE

3.1 Copyright

3.1.1 All materials (including software and content whether downloaded or not) contained on this website are owned by LINGUAFUN™, unless indicated otherwise. You agree and acknowledge that the materials are valuable property and that other than any specific and limited license for use of content that you may purchase from this website to use such materials, you shall not acquire any ownership rights in or to such materials. The material may not be used except as provided for in these terms, without our written permission. When your school's subscription expires, you are not authorised to use any resources off the Linguafun website any longer. The printable resources are authorised to be used by the subscribing school only during the duration of their subscription and any copies that you may have left should ceased to be used and destroyed immediately.

3.2 Trademarks

3.2.1 All trade marks, logos, images, product and company names displayed or referred to on this website are the property of Linguafun™. Nothing on this website grants you any licence or right to use, alter or remove such material.

3.3 Disclaimer of Contents

3.3.1 Linguafun™aims to keep the contents of the site accurate and up-to-date, however errors can occur and you should not rely completely on the information provided.

3.3.2 Because of the nature of delivery of the site contents we rely heavily on Internet connections. We will not be held responsible should you be unable to access the website due to a technical fault other than our own.

4. SUBSCRIPTION FEE

4.1 The annual subscription fee is the amount currently advertised on the Linguafun website and should be paid within 30 days of receiving the invoice. If payment is not received within 30 days of receiving the invoice, we reserve the right to charge a late payment fee of £12 and a daily interest of 1.5%, calculated on the outstanding balance.

4.2 Once your account has been activated, we will be unable to offer any refund of fees paid, as there is a free preview available to try before you buy.

5. GENERAL TERMS AND CONDITIONS

5.1 Remedies For Breach

5.1.1 Linguafun™ reserves the right to revoke your membership, should you or your pupils commit a breach of these Terms and Conditions.

5.2 No Waiver

5.2.1 If we delay exercising or fail to exercise or enforce any right available to us under these Terms and Conditions, such delay or failure does not constitute a waiver of that right or any other rights under these Terms and Conditions.

5.3 Force Majeure

5.3.1 We will not be liable to you for any lack of performance, or the unavailability or failure, of this website or our services, or for any failure by us to comply with these Terms and Conditions, where such lack, unavailability or failure arises from any cause reasonably beyond our control.

5.4 Third Party Rights

5.4.1 Nothing in these Terms and Conditions confers on any third party any benefits under the provisions of the Contracts (Rights of Third Parties) Act 1999.

6. SITE UPDATES

6.1 Linguafun™ continually strives to improve the service it provides. We aim to minimise disruption by updating or modifying the site outside of normal school hours.

7. TERMS OF USE

7.1 Disputes arising here shall be exclusively subject to the jurisdiction of the courts of England and Wales.
